Ex-hedge fund trader charged in $276M insider ploy

NEW YORK (AP) ? A former hedge fund portfolio manager was arrested Tuesday in what prosecutors called perhaps the most lucrative insider trading scheme of all time ? an arrangement to obtain secret, advance results of tests on an experimental Alzheimer's drug that netted more than $276 million for his fund and others.

The case also led authorities to investigate the activities of one of the nation's wealthiest hedge fund managers, billionaire Steven A. Cohen.

The portfolio manager, Mathew Martoma, was accused in U.S. District Court in Manhattan of using the information to advise other investment professionals to buy shares in the companies developing the drug, then later to dump those investments and place financial bets against the companies when the tests returned disappointing results.

"The charges unsealed today describe cheating coming and going," U.S. Attorney Preet Bharara said at a news conference. The scheme unfolded "on a scale that has no historical precedent."

Martoma's trades helped reap a hefty profit from 2006 through July 2008, while he worked for CR Intrinsic Investors LLC of Stamford, Conn., an affiliate of SAC Capital Advisors, a firm owned by Cohen.

Cohen is not referred to by name in court papers but is frequently alluded to for his dealings with the defendant in the weeks leading up to an announcement about the drug trial.

The government has been scrutinizing SAC since at least November 2010, when the FBI subpoenaed SAC and other influential hedge funds. Martoma is the fourth person associated with SAC Capital to be arrested on insider trading charges in the last four years.

SAC spokesman Jonathan Gasthalter said the company and Cohen "are confident that they have acted appropriately and will continue to cooperate with the government's inquiry."

The FBI said the scheme developed after Martoma met a doctor in Manhattan involved in an Alzheimer's drug trial in October 2006. According to a criminal complaint, he later obtained confidential information related to the final results of a drug trial.

Martoma's attorney, Charles Stillman, called his client "an exceptional portfolio manager who succeeded through hard work and the dogged pursuit of information in the public domain. What happened today is only the beginning of a process that we are confident will lead to Mr. Martoma's full exoneration."

Martoma was arrested at his home in Boca Raton, Fla., and made an initial appearance in federal court in West Palm Beach, Fla., where he was released on $5 million bail on charges of conspiracy to commit securities fraud and securities fraud. He was scheduled to return to court Monday in Manhattan.

The defendant will have great incentive to cooperate with the government because the size of the gains would add years, if not decades, to any potential sentence upon conviction, said John Sylvia, co-chairman of the securities litigation practice at the Mintz Levin law firm in Boston.

He said it was clear from reading the court papers that Cohen was referenced frequently and was a likely target of investigators, though they might not be able to build a sufficient case against him.

"There's little doubt as to where the government's sights are," Sylvia said. "I don't think it takes Sherlock Holmes to figure it out."

The Securities and Exchange Commission filed civil papers in the case against CR Intrinsic Investors, Mathew Martoma and Dr. Sidney Gilman. The civil complaint said the illegal money was earned in July 2008, when various hedge funds traded ahead of a negative public announcement involving the clinical trial results of an Alzheimer drug being jointly developed by Elan Corp. and Wyeth, both pharmaceutical companies.

The SEC complaint said that Martoma carried out the scheme with Gilman, an 80-year-old professor of neurology at the University of Michigan Medical School who served as chairman of a safety committee overseeing the clinical trial. Gilman was selected by Elan and Wyeth to present the final clinical trial results at a July 29, 2008, medical conference.

Messages left with the University of Michigan Medical School were not immediately returned.

Gilman's lawyer, Marc Mukasey, said his client is cooperating with the SEC and the U.S. Attorney's Office, and has entered into a non-prosecution agreement with federal prosecutors.

A copy of the agreement released by federal prosecutors Tuesday showed that Gilman will forfeit nearly $187,000 that he received from Elan for consulting work in 2007 and 2008 and from an expert networking firm for consultations between 2006 and 2009 with Martoma's hedge fund.

Bharara said Martoma gained from "cultivating and corrupting" Gilman, eventually receiving $9 million in bonus pay for the year when the trades were made.

Martoma met with the doctor about 42 times, beginning in the summer of 2006, and eventually convinced him to start talking about the drug trial, prosecutors said.

The SEC said leaks by Martoma caused hedge fund portfolios managed by CR Intrinsic and by an affiliated investment adviser to liquidate more than $700 million in holdings in Elan and Wyeth.

The massive repositioning, the SEC said, allowed CR Intrinsic and various hedge funds to reap huge illicit profits and avoid steep losses.

"By cultivating and corrupting a doctor with access to secret drug data, Mathew Martoma and his hedge fund benefited from what might be the most lucrative inside tip of all time," Bharara said.

The prosecutor said the doctor sent him a draft of the 24-page presentation he planned to make at a conference announcing the results.

That is when Martoma "had to do a spectacular about-face because he understood that ? with these negative results looming ? the hedge fund's massive $700 million stake had become a terrible bet," Bharara said. "And so, just like that, overnight, Martoma went from bull to bear as he tried to dig his hedge fund out of a massive hole."

The news caused Elan's stock price to plunge by more than 40 percent. The price of Wyeth fell about 12 percent.

The bets against the drug developers brought additional profits totaling $76.2 million. That is roughly the same amount that prosecutors said former hedge fund manager Raj Rajaratnam made in illegal profits before he was arrested. The one-time billionaire is serving an 11-year prison sentence in what was once considered the biggest insider trading case in U.S. history.

A year later, a hedge fund employee recommended that Martoma be terminated, and he was let go in 2010, Bharara said.

Virtusize searches for the perfect online fit - PandoDaily

There?s a slight snag with shopping online for clothes?? you?re never quite sure if they?re going to fit. Companies have been trying everything from 3D models to augmented reality to solve the problem, but Stockholm startup Virtusize thinks it has a better way.

Virtusize asks shoppers to compare the size of a garment they want to buy with a garment they already own. By punching in that garment?s measurements into Virtusize?s Web app, which is hosted on partner shopping sites, shoppers get a visual representation of how well the desired item will fit. Virtusize?s logic is that a tape measure on an item of clothing is a more accurate representation of how well something will fit than measuring body shape.

Alternatively, shoppers can indicate to Virtusize that they already own a particular garment from a certain store and of a certain size, so the app can use that as a point of reference. Virtusize overlays the size of the shopper?s currently owned garment on top of the desired item, all in a very snazzy interactive graphic.

The 18-month-old company has partnered with 20 shopping sites in Scandinavia, Austria, Germany, and the UK, but they?ve also started talks in the US, which they say is a major target. Its ambition is to be the global standard for size and fit on fashion ecommerce sites and platforms.

Peder Stuber, one of the 10-person company?s five co-founders, said today that Virtusize is focusing squarely on the size and fit of clothing, not design. Clothing sizes vary dramatically across markets and between brands, he noted, and there is no universal standard. The company?s CEO, Gustaf Tunhammar, came up for the idea for Virtusize after being frustrated by having to frequently returns T-shirts he bought online that didn?t fit.

Clothing returns are costly for retailers. Not only are there the inherent postage and handling costs, but often the returned items have to go straight onto the discount rack, because they go out of season.

Technology companies have been trying to solve the online fitting conundrum in many ways, including with full-body scanners, digital avatars, and robotics. One of Virtusize?s major competitors is Boston?s True Fit, which uses data-driven algorithms to calculate a customer?s size and shape, according to the Wall Street Journal. It recommends a size for each garment and describes how it fits around the bust and hips. Because True Fit is secretive about how it does its calculations, it is difficult to assess how successful and scalable its method will prove to be. Other competitors include Clothes Horse and Fits.me.

Stuber believes Virtusize?s approach is very scaleable. It relies on getting measurement information for each garment from retailers or brands, which is then fed into Virtusize?s system. Each garment is then visually outlined within the app whenever a shopper clicks on the Virtusize button within a product page. The 2D approach is also preferable to 3D models, Stuber argued, because 3D can sometimes hide how tight or loose a piece of clothing might hang on the body.

Virtusize raised an undisclosed seed round from Swedish investment firm ?resund and angel investors, including a former eBay executive. Its biggest partnership is with Nelly.com, a leading online retailer in Sweden.

Surveying Earth's interior with atomic clocks

ScienceDaily (Nov. 12, 2012) ? Have you ever thought to use a clock to identify mineral deposits or concealed water resources within the Earth? An international team headed by astrophysicists Philippe Jetzer and Ruxandra Bondarescu from the University of Zurich is convinced that ultraprecise portable atomic clocks will make this a reality in the next decade. The scientists argue that these atomic clocks have already reached the necessary degree of precision to be useful for geophysical surveying. They say that such clocks will provide the most direct measurement of the geoid -- Earth's true physical form. It will also be possible to combine atomic clocks measurements to existent geophysical methods to explore the interior of Earth.

Determining geoid from general relativity

Today, the Earth's geoid -- the surface of constant gravitational potential that extends the mean sea level -- can only be determined indirectly. On continents, the geoid can be calculated by tracking the altitude of satellites in orbit. Picking the right surface is a complicated, multivalued problem. The spatial resolution of the geoid computed this way is low -- approximately 100 km.

Using atomic clocks to determine the geoid is an idea based on general relativity that has been discussed for the past 30 years. Clocks located at different distances from a heavy body like our Earth tick at different rates. Similarly, the closer a clock is to a heavy underground structure the slower it ticks -- a clock positioned over an iron ore will tick slower than one that sits above an empty cave. "In 2010 ultraprecise atomic clocks have measured the time difference between two clocks, one positioned 33 centimeters above the other," explains Bondarescu before adding: "Local mapping of the geoid to an equivalent height of 1 centimeter with atomic clocks seems ambitions, but within the reach of atomic clock technology."

Geophysical surveying with atomic clocks

According to Bondarescu, if an atomic clock is placed at sea level, i.e., at the exact altitude of the geoid, a second clock could be positioned anywhere on the continent as long as it is synchronized with the first clock. The connection between the clocks can be made with fiber optics cable or via telecommunication satellite provided that the transmission is reliable enough. The second clock will tick faster or slower, depending on whether it is above of beneath the geoid. The local measurement of the geoid can then be combined with other geophysical measurements such as those from gravimeters, which measure the acceleration of the gravitational field, to get a better idea of the underground structure.

Mappings possible to great depths

In principle, atomic clock surveying is possible to great depth provided that the heavy underground structure to be studied is large enough to affect the tick rates of clocks in a measurable manner. The smallest structure that atomic clocks accurate to 1 centimeter in geoid height can determine is a buried sphere with a radius of about 1.5 kilometer buried at 2 kilometers under the surface provided it has a density contrast of about 20% with the surrounding upper crust. However, scientists estimate that the same clocks would be sensitive to a buried sphere with a radius of 4 kilometers at a depth of about 30 kilometers for the same density contrast.

Currently, ultraprecise atomic clocks only work in labs. In other words, they are not transportable and thus cannot be used for measurements in the field. However, this is all set to change in the next few years: Various companies and research institutes, including the Centre Suisse d'Electronique et de Microtechnique CSEM based in Neuch?tel, are already working on the development of portable ultraprecise atomic clocks. "By 2022 at the earliest, one such ultraprecise portable atomic clock will fly into Space on board an ESA satellite," says Professor Philippe Jetzer, the Swiss delegate for the STE-Quest satellite mission aimed at testing the general relativity theory very precisely.

As early as 2014 or 2015, the "Atomic Clock Ensemble in Space ACES" is to be taken to the International Space Station ISS. ACES is an initial prototype that does not yet have the precision of STE-QUEST.

Our family of seven didn?t set goals. We created New Year?s resolutions, Lenten intentions, and Advent ?angel? acts, but no ?goals,? per se.

After I attended a Nightingale-Conant seminar? in my early twenties, I began to set goals.

In a non-scientific way I studied goals. First, I worked with the ?SMART? acronym, ensuring my goals were each:

  • Specific
  • Measurable
  • Attainable
  • Realistic/relevant
  • Time-bonded

?What was I missing??

Even when my goals seemed SMART-perfect, I could fail.

I read books by?self-improvement gurus like Brian Tracy.

  • ?Goals! How to Get Everything You Want ? Faster than You Ever Though Possible?
  • ?Change Your Thinking Change Your Life ? How to Unlock Your Full Potential for Success and Achievement?

This led to practices like re-writing goals daily. Until recently, I had dozens of journals with page after page of handwritten goals.

Still searching for the ?Aha!? connection, I devoured Rosamund Stone Zander and Benjamin Zander?s ?The Art of Possibility: Transforming Professional and Personal Life.?

Then, a major success led me to realize a new mind-body connection.

My desire to lose weight once and for all caused me to enroll in a 90-day ?Body for Life? challenge.

Initially, I worked to integrate the meal plan with my lifestyle. (Body for Life encourages frequent, high-protein, small meals.)

It wasn?t until I understood the importance of food and exercise intensity in unison that I began to see significant results.

As my exercise intensity increased, I felt different. Instead of exhaustion after a workout, I noticed energy later in the day.

My commitment became a given approximately halfway through the challenge. I no longer questioned my reasons for participation or the probability of my success.

At the end of the challenge, I?d lost 17 pounds and more than 17 inches.

My physical transformation from a size 12 to a size 8 was significant. More importantly, my mindset altered forever, ?for life.?

You would think that this success mindset meant ?I got it. Repeatable. Guaranteed!? Not so.

I experimented, searching for the perfect mind/body connection that would ensure every goal acheived.

I tried writing my goal list, sealing it in an envelope and then, some months later, reconciling intentions with results. Sometimes the surprise was bigger than expected, as if to prove the thought could direct life actions.

Using short-bursts, such as 21-day goals, I modified habits and thoughts to accommodate my efforts.

When someone suggested I might be driven by goals, I dropped them for a time. No goals left me feeling less directed, less purposeful and less successful.

Obviously, goals fascinate me. Thanks to Tony Robbins, I?ve added clarity and purpose to my goals.

Brendon Burchard?s bestseller, ?The Charge? caused me to focus even more intently on directing goal achievement through mindfulness.

High Performance Academy, a live event from Brendon Burchard, took the goal process to yet another level, emphasizing that goals are about the journey, not the destination.

My conclusion: I plan to happily continue to think about, read about, and set goals. I?ll recommend goals for others.

In the words of Joseph J. Lamb:

The road to success leads through the valley of humility, and the path is up the ladder of patience, and across the wide barren plains of perseverance. As yet, no short cut has been discovered.

The Need for an Industry-based Java Exam - Computing Education ...

Barbara has been facing a challenge in dealing with the State of Georgia lately that could impact other states. I offered my blog as a forum for raising the issues more broadly.

We have a real need in Georgia for a certification exam for high school students that is similar to the AP CS A exam in content and price, but is industry-based. Georgia is pushing career pathways and wants to have each student who completes a pathway take some type of exam where they can earn an industry certification. They claim this is due to the Perkins legislation that passed in 2006.

The purpose of the Perkins legislation is to develop students for ?high skill, high wage, or high demand occupations in current or emerging professions? which certainly matches computing jobs. It is also intended to ?integrate rigorous and challenging academic and career and technical instruction, and link secondary education and postsecondary education for participating career and technical education students?. It goes on to say that the goal is ?designed to provide students with a non-duplicative sequence of progressive achievement leading to technical skill proficiency, a credential, a certificate, or a degree.? Since students can receive academic credit for the the Advanced Placement (AP) Computer Science (CS) A exam from postsecondary institutions, the AP CS A exam should count as leading to a degree.

In Georgia, we have created a computing pathway which has 3 courses: Computing in the Modern World, Beginning Programming, and Intermediate Programming. The committee that created the computing courses had recommended that that pathway end with AP CS A instead of Intermediate Programming, and that the students pass the AP CS A exam to prove that they have learned the material. But, Georgia won?t allow the AP exam to be used as an end of pathway exam. I recommended the Oracle Java associate exam, but it is $300 and that is just too expensive. The AP exam is $89. Georgia has picked a Skills USA computer programming exam (see description here) that covers Java, C++, and Visual Basic. That exam doesn?t match the standards in the pathway courses, and we don?t want the teachers to have to teach 3 different languages. We are having a hard enough time getting them up to speed on Java, since most have no computer science background. The Career and Technical Education Department in Georgia thinks it is preparing kids for programming jobs right out of high school, which is not realistic. Students will need to at least an associates degree if they want a career in computing.

Georgia is poised to force every rising 9th grader to pick a career pathway. They are currently thinking about changing our computing courses to match the Skills USA test, since they can?t find a cheaper test that gives industry certification in Java. This is a huge problem. We have been working for years to improve computing in Georgia, and this would reverse many of our gains. We have introduced interesting and engaging courses using Scratch, Alice, Media Computation in Java, CS Unplugged, Greenfoot and App Inventor. Teachers would have to go back to boring, cookbook programming to get through 3 languages in 3 courses.

The Georgia DOE says is not going to change to allow an AP exam as an end of pathway exam. They claim they can?t since their efforts are part of the Race to the Top grant that Georgia won. They interpreted the Perkins legislation to mean that students must earn an industry certification. Other states may also use this same narrow interpretation and could end up in the same situation. This could be a major road block to the National Science Foundation?s plan to prepare 10,000 teachers (CS10K) to teach the new AP CS Principles course by 2016.

I recommend that Oracle create a new certificate only for high school students that is based on the AP CS A exam material and costs about $89. It could be a subset of the Java Associate material that matches the AP CS A material (extra topics to remove are: Java Development Fundamentals, Java Platforms and Integration Technologies, Client Technologies, Server Technologies).
